This page (together with any documents referred to on it) explains to you the terms on which you may make use of the website (hovertravel.co.uk) (“the Website”) including the booking portal (“Manage My Booking Portal”). Please read this Disclaimer and Terms of Use carefully before you start to use the Website. By using this Website, you indicate that you accept this Disclaimer and Terms of Use and that you agree to abide by the terms and conditions set out in this Disclaimer and Terms of Use. If you do not agree to this Disclaimer and Terms of Use, please refrain from using any part of the Website.

1. The Website is operated by Hovertravel Limited, a company registered in England and Wales under company number 00830401 whose registered office is at Encombe House, Estate Office, Corfe Castle, Wareham, Dorset, BH20 5LW, England. (“Hovertravel”).
2. Access to the Website is permitted on a temporary basis and Hovertravel reserves the right to withdraw or amend the service (including the Manage My Booking Portal) together with any information or function provided on the Website without notice. Hovertravel do not guarantee that the Website, or any content on it, will always be available or be uninterrupted. Hovertravel shall not be liable if for any reason the Website or any part thereof is not available at any time or for any period. From time to time, Hovertravel may restrict access to some parts of the Website, or the entire Website, if required. The Manage My Booking Portal can only be accessed by those users who have registered a valid account and comply with the eligibility requirements set out in paragraph 3 below
3. To set up an account for the Manage My Booking Portal you must be an individual, over the age of 16 and resident in the United Kingdom.  
4. Hovertravel aims to update the Website regularly and may change the content and functionality at any time. Hovertravel may therefore have to suspend access to the Website, or close it if necessary. Any of the material on the Website may be out of date or incorrect (e.g. pricing) at any given time and Hovertravel is under no obligation to update such material, however will use all reasonable endeavours to correct errors or omissions as quickly as practicable after being notified of them.
5. You are responsible for making all arrangements necessary for you to have access to the Website and for ensuring that all persons who access the Website through your internet connection are aware of these terms and that they comply with them.
6. Hovertravel shall not be liable for and accepts no responsibility for any information presented by a third party including, but not limited to, pricing, liability in connection with any bookings and cancellations made directly with a third party, or any other transactions between you and a third party, and the performance of the contract entered into between you and the third party or any circumstances that may arise during your travel arrangements and/or services.
7. All travel arrangements and/or services shown on the Website are subject to availability and you must always check with Hovertravel to see whether travel arrangements and/or services are available prior to arranging any booking. You may book travel arrangements and/or services with Hovertravel through your Manage My Booking Portal or by contacting Hovertravel by telephone or email
8. Any links provided on the Website to other websites are not intended to provide an endorsement by Hovertravel (unless otherwise specified) and Hovertravel will have no liability or responsibility for the content of this or those websites whatsoever. You must not establish a link to this Website from any other website without Hovertravel’s explicit written consent.
9. Hovertravel cannot guarantee that the Website is error free or free from infection by viruses or anything else that has contaminating or destructive properties.
10. You must not misuse the Website by:

1. using the Website in a manner that breaches applicable laws or regulation;
2. using the Website in a manner which is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect;
3. by using the Website in a manner (including uploading content to the Website) which infringes the intellectual property rights of any third party;
4. introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful;

2. Any travel information on this Website written or provided by Hovertravel is purely for information. Hovertravel endeavours to ensure that such information is accurate, however Hovertravel provides no guarantee that such information is accurate. This information does not form part of your agreement with Hovertravel or any other third party and is provided solely as additional background content. Hovertravel shall not be held liable in any way whatsoever for any inaccuracy, misunderstanding or expectation drawn from this content.

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures when setting up and otherwise accessing the Manage My Booking Portal you must treat such information as confidential. You must not disclose it to any third party. Hovertravel have the right to disable any user identification code or password, whether chosen by you or allocated by Hovertravel, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use. If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify Hovertravel at info@hovertravel.com.
4. All rights in the Website, including copyright, the content and design of the Website, is owned by Hovertravel or used under licence from third party owners. Any use of this Website or its contents, including copyright or storing it or them in whole or part, other than for your personal or non-commercial use is prohibited without the permission of Hovertravel. You are prohibited from copying, modifying, transmitting, distributing, selling, displaying, licensing or reproducing any content including images and other media on this Website for any commercial purpose.
5. Where you upload content to the Website, you retain all of your ownership rights in your content, but you are required to grant Hovertravel a limited licence to use, store and copy that content to enable Hovertravel to provide its services. Any material you upload to the Website will be considered to be non-confidential and non-proprietary and Hovertravel has the right to use, copy, distribute and disclose to third parties any such material for any purpose.
6. Hovertravel may from time to time provide interactive services on the Website. Hovertravel are under no obligation to oversee, monitor or moderate any interactive service, and expressly exclude liability for any loss or damage arising from the use of any interactive service by a user in contravention of this Disclaimer and Terms of Use whether the service is moderated or not.
7. If you breach the provisions of this Disclaimer and Terms of Use, Hovertravel shall be entitled to suspend or permanently terminate your access to the Website.

To the maximum extent permitted by law, Hovertravel disclaims all liability, representations, warranties, whether express or implied by statute, custom or usage relating to the information contained in or services offered on this Website. This does not affect your statutory rights under English law. Hovertravel shall not be liable for any losses or damages (whether direct, indirect or consequential) whatsoever, whether in contract, tort (including negligence), or otherwise arising from this Website, or from any interruption or delay in accessing this Website.

12. Hovertravel may transfer our rights and obligations under these terms to another organisation. Hovertravel will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights.
13. It is not the intention of the parties to confer any rights on any third parties by virtue of this Disclaimer and Terms of Use and accordingly the Contracts (Rights of Third Parties) Act 1999 shall not apply to this Disclaimer and Terms of Use.
14. This Disclaimer and Terms of Use and any disputes that may arise between you and Hovertravel will be governed by the laws of England and Wales and the parties shall submit to the jurisdiction of the English courts.
